Terms of Service

Effective date: 20 October 2026

In short: Alien Memory Invaders is free to play. You can buy coins and boosters with real money; they are a licence to use virtual items in the Game, have no cash value and are generally not refundable except where the law or the app store says so. Your progress lives only on your device. Watching ads is always optional.

1. Acceptance

These Terms are an agreement between you and Taras Makota ("we", "us") about the Alien Memory Invaders game and any updates to it (the "Game"). By installing or playing the Game you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Game.

2. The Game

Alien Memory Invaders is a memory game: open saucers, match the aliens inside, and destroy them before the fleet lands. It has an Adventure mode with levels, an Endless mode, and a tutorial. We may change, add or remove features, levels, items and prices, and we may stop offering the Game, but we won't take away items you have paid for while the Game remains available to you.

3. Who can play

If you are under the age of majority where you live, you may play only with the permission of a parent or guardian, who agrees to these Terms on your behalf and is responsible for purchases made on your device. Parents can turn off in-app purchases in the device's parental controls (Screen Time on Apple devices, Family Link or Play Store settings on Android).

4. Coins and boosters

Coins, freeze boosters, sonar boosters, spare batteries and other items in the Game ("virtual items") are not money or property. Whether you earn them or buy them, you get a limited, personal, non-transferable, revocable licence to use them in the Game. They have no cash value, can't be exchanged for real money or anything outside the Game, and can't be sold or transferred.

5. Purchases and refunds

Purchases are made through the App Store or Google Play, and those stores' terms govern payment, billing and refunds. Prices are shown in the shop in your local currency before you buy. Virtual items are delivered as soon as the store confirms the payment.

Because virtual items are delivered and can be used immediately, purchases are final except where the store or the law gives you a right to a refund. If you live in the EU or UK, you agree that delivery starts right after the purchase and you acknowledge that you lose your right of withdrawal once it does. To request a refund, contact Apple or Google Play. If items you paid for didn't arrive, write to us with the store receipt and we'll sort it out. If a purchase is refunded, we may remove the items it delivered.

6. Ads

The Game shows rewarded video ads only when you choose to watch one, to continue after losing. The reward is given when the ad is watched to the end; if the ad isn't available or is closed early, no reward is given. Ads are provided by Google AdMob. We're not responsible for the content of third-party ads or the websites they link to.

7. Your progress

Progress and virtual items are stored only on your device. They are not backed up by us and can't be recovered if you uninstall the Game, reset or lose your device. The Starter Kit can be restored through the store; other purchases are consumed when delivered and can't be restored.

8. Fair play

You agree not to:

If you do, we may remove affected items or stop supporting your use of the Game.

9. Intellectual property

The Game, including its code, art, characters, music, sounds and text, belongs to us or our licensors and is protected by law. These Terms give you a personal, non-exclusive, non-transferable licence to install and play the Game on devices you own or control, for your own non-commercial entertainment.

10. Apple and Google

These Terms are between you and us, not Apple or Google, and we, not they, are responsible for the Game. If you got the Game from the App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them; Apple has no obligation to provide maintenance or support, and to the extent the law allows, Apple has no warranty obligation for the Game beyond refunding its purchase price (the Game is free). Your use must also comply with the store's own terms, such as Apple's Licensed Application End User License Agreement.

11. Disclaimer of warranties

To the extent the law allows, the Game is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose and uninterrupted or error-free operation.

Some places don't allow these exclusions, so they may not all apply to you. Your statutory rights aren't affected.

12. Limitation of liability

To the extent the law allows, we won't be liable for indirect, incidental, special or consequential damages, or for loss of data, progress, virtual items, profits or goodwill. Our total liability for any claim about the Game is limited to the amount you paid us in the 12 months before the claim, or EUR 50 if that is more.

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law.

13. Changes to these Terms

We may update these Terms. If a change is significant, we'll tell you in the Game before it takes effect. The effective date at the top shows the latest version. If you keep playing after a change takes effect, you accept the new Terms; if you don't agree, stop using the Game.

14. Governing law and disputes

These Terms are governed by the laws of Ukraine. Disputes will be handled by the competent courts of Lviv, Ukraine. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country you live in, including the right to bring a claim in your local courts where those laws allow it. Please contact us first. Most issues can be sorted out quickly.
